Save as otherwise specifically mentioned the intellectual property rights in all content published on the CCREEE website are the property of the CCREEE and such material is protected by copyright and other intellectual property laws of Barbados and other jurisdictions. No such material may be reproduced in whole or in part or used to create derivative works without the express permission of the CCREEE save that, unless otherwise specified in relation to any specific document or piece of material, information, documents or material from the site may be downloaded, copied or reprinted for non-commercial purposes only subject to the user giving proper attribution to the CCREEE.

From time to time the CCREEE may with the express permission of the author post third party material on our site. The intellectual property rights in such material shall at all times remain the property of the author. No such third party material may be reproduced in whole or in part or used to create derivative works without the express permission of the author save that, subject to any stipulation to the contrary in relation to any specific piece of material, the user may download, copy or reprint such third party material for non-commercial purposes only provided that proper attribution is given to the author.

 

Governing Law

These terms and conditions shall be governed by and construed in accordance with the substantive law of Barbados.

 

Indemnity

As a condition of use of the CCREEE website, the user agrees to indemnify the CCREEE and its servants and agents from and against any and all actions, claims, losses, damages, liabilities and expenses (including legal costs and fees) arising out of the use by the user of the site and/or any material contained thereon, including, without limitation, any claims alleging facts that if true would constitute a breach by the user of these terms and conditions.

 

Settlement of Disputes

Any dispute, difference or claim arising out of or relating to or in connection with the CCREEE website or the contents or use thereof or these terms and conditions shall be submitted to and finally determined by arbitration. Such arbitration shall be conducted by a single arbitrator and shall be conducted in Barbados and in the English language. The decision of the arbitrator shall be binding on the CCREEE and the user and enforceable in any court of competent jurisdiction. The user agrees to submit to the exclusive jurisdiction of the courts of Barbados for the resolution of any dispute not subject to arbitration and for the enforcement of any award made by the arbitrator.

 

Remedies

The user hereby agrees and acknowledges that the intellectual property rights in the material and information contained on or accessible via the CCREEE website are owned by the CCREEE and/or third party content providers. The user further agrees and acknowledges that the rights and interests of the CCREEE and/or any third party may be irreparably injured by unauthorized use of any material or information contained on or accessible via the CCREEE website and, further, that monetary damages would not be an adequate remedy for any breach of the terms and conditions governing the use of the site and/or such material and information. The user therefore agrees that notwithstanding and in addition to any other rights or remedies available to the CCREEE and/or any third party in respect of the breach of these terms and conditions the CCREEE and/or any third party shall be entitled to seek specific performance and injunctive or other equitable relief in connection with any breach or anticipated breach of said terms and conditions, including interim relief from a court of competent jurisdiction.

 

Privacy

The collection of all data and personal information by the CCREEE through this website shall be subject to and in accordance with the privacy policy from time to time of the CCREEE. Please take a few moments to read our Privacy Policy, which sets out the manner in which all information obtained from you shall be treated by the CCREEE.

 

General

If the user is dissatisfied with any material on the CCREEE site or with any of terms and conditions of use of the site, the sole and exclusive remedy of the user is to discontinue use of the site.

No failure to or delay in the exercise of any right power or remedy available to the CCREEE pursuant hereto shall impair such right power or remedy or be construed as a waiver thereof. No waiver of any of these terms and conditions shall be binding except as made in writing and signed by the duly authorized representative of the CCREEE.

Nothing contained in the CCREEE website or in these terms and conditions shall operate to waive or limit or be construed as waiving or limiting any rights, privileges or immunities of the CCREEE.
